The Latest Move to Keep Hemp THC Products Off the Market

Senator Rand Paul, a Republican from Kentucky, has introduced an amendment designed to maintain the federal ban on hemp-derived tetrahydrocannabinol (THC) products. This comes as lawmakers prepare for a November vote that could determine the regulatory fate of these products nationwide. The amendment seeks to block the U.S. Food and Drug Administration (FDA) from authorizing hemp-derived THC in food and dietary supplements, effectively keeping these products off the shelves for the foreseeable future.

Who Stands to Be Impacted?

The amendment primarily affects producers and consumers of hemp-derived THC edibles, tinctures, and other ingestible products. While the 2018 Farm Bill legalized hemp cultivation and set the THC limit at 0.3% for hemp plants, the emergence of products containing higher concentrations of hemp-derived THC has created regulatory confusion and controversy.
